Uvalde and Mental Health

May 24, 2022, is a date that will forever haunt Robb Elementary School and the people of Uvalde, Texas. For those in school, the end of May signifies the end of the school year. It marks that time when summer break is around the corner, school assignments are winding down (or almost nonexistent), end-of-year classroom celebration parties happen, along with end-of-year assemblies. May 24, 2022, quickly turned into a parent’s, teacher’s, and student’s worst nightmare. May 24, 2022, ended in tragedy when 19 students and two teachers were callously murdered in a school shooting.[1]

The legal system’s Latin roots contribute to the confusion surrounding its terminology, especially because Latin is now referred to as a dead language. Which Rights Does The TCPA Protect?

The Texas Citizens Participation Act (TCPA) commonly known as Texas’ Anti-SLAPP Statute, found in Chapter 27 of the Texas Civil Practice and Remedies Code, functions as a constitutional safeguard that protects the rights of persons to petition, speak freely, associate freely, and otherwise participate in government to the maximum extent permitted by law. TCPA allows defendants to file a motion to dismiss (within 60 days of being served) alleging that the causes of action asserted against them are based on the defendants’ exercise of his/her First Amendment rights. A TCPA motion to dismiss stays discovery automatically while a decision from the court is pending.
